CL Industries, Inc. (CLI) warrants its preblended pool finishes, against Manufacturing defect for 10 years from the date of installation pursuant to the terms below. Covered brands include Hydrazzo Series, Krystal Krete, SunStone Series, CrystalStones Series, and SunStone Pearl Series.
This Limited 10 Year Warranty is effective only if the application of the product is performed by a factory approved authorized applicator. Staining and/or hydration is not a manufacturer defect, therefore it is not covered under this warranty.

This warranty excludes damage caused directly or indirectly by an act of God, including any natural disaster such as a hurricane, earthquake, tornado, flood, lightning, hail, fire, or any abnormal deterioration due to any cause including, and without limitation to, plant or animal life is not covered.
This warranty is subject to the following terms and conditions, each of which are mutually dependent with CLI’s obligations.
This warranty must be accepted by the Pool Owner by checking the box below. The warranty registration must be printed and kept by the Pool Owner. Possession of the warranty is a condition precedent to any claim under this warranty.

1. Damages due faulty workmanship or improper storage of material are not covered by this warranty.
2. Quartz, stone, application techniques and pigment loss can result in variations of color, shade and appearance. Such variations are not product defects.
3. Labor costs for warranty repairs are not included in the warranty coverage. If material is defective when shipped from CLI then CLI’s sole responsibility will be to provide such replacement material for the defective area only as is then manufactured by CLI, in such color as will most closely match the existing shade. Some cosmetic and color variation may result. (THERE ARE NO OTHER WARRANTIES, EXPRESS OR IMPLIED. THERE IS NO WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.)
4. Pool finishes may not be covered if they have experienced physical damage, fading, or if there’s a lack of proper water chemistry balancing, chemical abuses, or sanitation applications. Monthly testing and documentation of pool chemistry by a reputable company using a computerized system is mandatory. Failure to provide monthly printed reports as documentation will void this warranty. Initial Start-ups should follow sound technical practices as specified by the National Plasterers Council (NPC) available at www.npconline.org. SEE REVERSE SIDE FOR POOL CARE INSTRUCTIONS. Additionally, this limited warranty does not apply to damage caused by structural failure, physical abuse to the pool.
5. Delamination, surface check cracking, cracks caused by structural defect or damage, or draining of the pool are not covered by this warranty.
6. Naturally occurring color variation, staining, mottling, and hydration are not covered by this warranty.
7. Damage due to acts of negligence, misuse, abuse, vandalism, war, or civil disobedience is not covered.
8. CL Industries shall not be liable for any incidental, special, consequential, or punitive damages, including without limitations, water and chemical replacement, and loss of use of the pool. Additionally, minor surface checking, “crazing,” and/or cracks are not covered by this warranty. This finish is not structural.
9. Misuse of the product and/or improper installation, installation outside a body of water, or use in applications for which it was not intended, including but not limited to negative edges, dam walls, beach entries, rolled bond beams, spillways, and waterfalls, are not covered.
10. Damage related to freezing and thawing, which includes cracking, delamination, and aggregate loss, is not covered.
11. The warranty is not valid unless the applicator has been paid in full.
12. The warranty is valid only in the Continental United States.
13. The warranty is not valid unless this registration is completed in full and within thirty (30) days of installation. At CLI’s discretion, proof of purchase and use may be required as a condition of this warranty. WARRANTY REGISTRATION MUST BE RETAINED BY POOL OWNER.
14. This warranty is issued to both the Pool Owner and the Contractor. The Contractor serves as the primary contact for any warranty claim inquiries. CLI does not offer inspection services. Should a pool inspection be desired, it can be arranged at the Contractor’s request, with the stipulation that the Contractor must be present during the inspection.
15. Disputes under this agreement will be decided by binding arbitration in accordance with the Pool and Hot Tub Alliance (PHTA). This warranty extends only to the pool owner identified above and is non-transferable.

The only obligation of CLI under this warranty is to deliver new material in substitution for that which was found to be defective. No other cost or expense, direct, collateral or incidental may be asserted under this warranty and all such claims are hereby waived by the Pool Owner.
